Terms of Service
Effective date: October 1, 2026
These Terms of Service ("Terms") are an agreement between you and Nail Hub LLC ("TNH," "we," "us," or "our"), which does business as TNH Business Solutions. They govern your use of tnhsolutions.biz, TNH Pro, our referral programs, and related websites, apps, and services (together, the "Services"). By accepting these Terms when creating an account or starting a trial, or by using the Services after being given notice of these Terms, you agree to them. If you do not agree, do not use the Services.
If you use the Services on behalf of a business, you confirm that you have authority to bind that business, and "you" means that business.
1.Who can use the Services
The Services are for businesses and professionals located in the United States. You must be at least 18 years old and able to form a binding contract to open an account. Some offers, such as insurance coverage, require a valid professional license or student enrollment. You are responsible for meeting the provider's eligibility requirements. Adult account eligibility does not mean that every client record a business lawfully maintains must concern an adult; the Privacy Policy and DPA address client information.
2.What we offer
TNH Pro. A subscription software product that includes a business website, online booking calendar, client reminders, and payment tools. TNH Pro is provided by TNH using third-party software platforms. Features and separately priced add-ons are described at signup.
Insurance referrals. TNH is a marketing partner of Elite Beauty Society. TNH is not a licensed insurance agency and does not sell, solicit, quote, negotiate, bind, or service insurance. Insurance is offered through the Elite Beauty Society program and the licensed insurance entities identified in its application and policy documents. See Partner Disclosures.
Payment processing referrals. Merchant processing is offered through Sleft Payments under separate merchant agreements with the entities identified in those agreements. TNH is not a bank, payment processor, or payment facilitator. See Partner Disclosures.
We also link to products sold by The Nail Hub. Purchases from The Nail Hub are governed by that site's own terms.
3.Third-party providers
Insurance, payment processing, and some software features are provided by third parties under their own terms. When you apply for or use a separately contracted product, you enter into an agreement directly with the provider identified in that agreement. TNH does not control that provider's approvals, denials, claims handling, rates, fund holds, or chargebacks.
This section does not eliminate TNH's own obligations under these Terms, the DPA, or applicable law for services TNH agrees to provide through its vendors.
4.Your account
Give accurate information at signup and keep it current. You are responsible for safeguarding your login credentials and managing access by team members. Tell us promptly at success@tnhsolutions.biz if you believe your account has been accessed without permission. Do not share passwords or allow unauthorized people to use your account.
5.Free trial, subscription, and cancellation
Free trial. New TNH Pro accounts get a 30-day free trial, with one trial per business. You can explore without entering a card. To continue after the trial, add a payment method and agree to the recurring charges shown at signup. If you do not add a payment method and authorize billing, your trial ends without a subscription charge. If you do authorize billing, the first charge occurs when the trial ends unless you cancel beforehand.
Price. After the trial, TNH Pro costs $9.99 per month for one location and up to five team members. Add-ons such as email marketing, text messaging, review management, and social tools are billed separately at the price and billing frequency shown before you activate them. Text messaging may also carry carrier and usage fees. Taxes may apply.
Automatic renewal. Your subscription renews monthly on the billing date shown in your account and charges your authorized payment method until you cancel. We email a receipt for each charge and a reminder before your first paid charge after the trial. Activating an add-on does not authorize unrelated charges.
How to cancel. Cancel from your dashboard under Settings or email success@tnhsolutions.biz from your account email address. Include the business name and a clear cancellation request. For billing purposes, an email cancellation is effective when we receive the request; a delay in our reply does not extend your subscription. Cancellation stops future renewals. Your existing access continues to the end of the paid billing period unless you request earlier closure or access must be restricted for legal or security reasons. Canceling before the trial ends prevents the first subscription charge. We will confirm cancellation by email.
Refunds. Monthly charges are non-refundable except where required by law, where we billed you in error, or as expressly stated in these Terms. Contact us promptly about a disputed charge, preferably within 60 days. This request does not shorten any rights or deadlines provided by law.
Failed payments. If a payment fails, we may retry it and will email you. If it remains unresolved for 14 days after our notice, we may pause paid features until payment is made. Amounts properly incurred before cancellation remain payable.
Price changes. We will give at least 30 days' notice by email before a subscription price increase. The new price applies to a billing period starting after the notice period. You may cancel before it takes effect.
Insurance and processing are not part of the TNH Pro subscription. Their charges, renewals, and cancellation are governed by the relevant provider agreements. Canceling TNH Pro does not automatically cancel those separate services.
6.Your content and your clients' data
As between you and TNH, you retain your rights in the content you upload, including logos, photos, service descriptions, and client records ("Your Content"), subject to other people's privacy and intellectual property rights. You give TNH a limited license to host, copy, display, and process Your Content only as needed to provide the Services and carry out your instructions, including the limited retention described in the DPA.
When you store information about your own clients, staff, or leads in TNH Pro, you control that information and TNH processes it on your behalf. Our Data Processing Addendum is part of these Terms. You are responsible for lawful collection and use, required notices, and any consent needed to text or email people.
7.Websites we build for you
If we build your TNH Pro website from information you send us, you are responsible for its accuracy and for having rights to the logos, photos, and text you provide. Review your site before using it with clients and keep it current. You may review and edit your site through the available tools or contact support for help. If you use a custom domain registered for your business, you remain its owner and registrant, subject to the registrar's terms and renewal fees. Access to TNH's hosted website tools and licensed templates ends with your subscription unless separately agreed in writing.
8.Acceptable use
These rules apply to you and team members on your account. You may not use the Services to:
- Message people without permission. Send texts or marketing emails without the consent required by these Terms, applicable law, and provider rules; use purchased or rented contact lists; or continue messages after a relevant opt-out.
- Break the law. Violate the TCPA, CAN-SPAM, professional licensing rules, consumer protection laws, privacy laws, or other applicable requirements.
- Mislead clients. Publish false prices, fake reviews, or misleading claims about services, credentials, or results.
- Offer prohibited services. Book or take payment for illegal services or services your license does not permit.
- Infringe rights. Upload material you do not have the right to use.
- Post harmful content. Upload hateful, harassing, sexually explicit, or violent content, or content that exploits minors.
- Store prohibited sensitive data. Keep Social Security numbers, full card numbers, or detailed medical records in client notes, messages, uploads, or other general-purpose fields. Enter card information only in the designated payment provider's secure payment fields. Do not use TNH Pro for HIPAA-regulated protected health information.
- Attack or misuse the Services. Access other accounts without permission, probe for vulnerabilities without authorization, upload malware, scrape data, overload systems, or evade usage limits.
- Resell the Services. Resell, sublicense, or white-label TNH Pro without our written agreement.
We may remove content, pause messaging, suspend, or close accounts that violate these rules. When feasible, we will explain the issue and allow a reasonable opportunity to correct it, but may act immediately where necessary to address fraud, security, legal, or provider risk. Documented carrier or email-provider penalties directly caused by your violation may be charged to you to the extent allowed by law. Report problems to success@tnhsolutions.biz.
9.Messaging tools
TNH Pro lets you send texts and emails to your clients. You are the sender and are responsible for compliance with the TCPA, CAN-SPAM, applicable state laws, and provider rules. Collect any required consent for your business, maintain consent records, provide required notices and opt-out methods, and honor opt-outs promptly. TNH's own SMS consent does not authorize a separate business to message someone.
Text messaging may require carrier registration, such as A2P 10DLC, and may carry usage fees. We may pause messaging because of complaints, carrier violations, or high opt-out or bounce rates. Our SMS Terms cover messages TNH sends to its own subscribers; your business must provide appropriate terms and notices for its messages to clients.
10.Our intellectual property
The Services, including software, designs, templates, videos, and educational materials, belong to TNH or its licensors, excluding Your Content. We give you a limited, non-exclusive, non-transferable right to use them as permitted by your subscription and these Terms. Except as permitted by law or written agreement, you may not copy, resell, reverse engineer, or use protected materials to create competing products. If you send feedback, we may use it without compensation, but this does not authorize use of Client Data beyond the DPA.
11.Educational content
TNH Business Fundamentals, TNH Financial University, and other videos, articles, and resources on our site are for general education. They reflect the experience and opinions of The Nail Hub team.
Not professional advice. Nothing in this content is individualized financial, investment, tax, accounting, legal, or insurance advice. We are not acting as your financial advisor, accountant, attorney, or insurance agent. Consult a qualified professional about your circumstances before making those decisions.
No guaranteed results. Pricing, income, client-growth, and savings examples are illustrations. Results depend on your skills, market, effort, and other factors. Investments can lose value, and past results do not predict future results.
Information can change. Tax rules, laws, and industry standards change, and educational material may not reflect the latest developments.
12.Availability and changes
We work to keep the Services running but do not promise uninterrupted or error-free availability. We may add, change, or remove features. If we materially reduce a core paid TNH Pro feature, we will notify you in advance when reasonably possible and you may cancel. If we discontinue the paid service before the end of a prepaid period without your breach, we will refund the unused portion of that period.
13.Suspension, account closure, and data export
You may cancel as described in Section 5. We may suspend or end access for a violation of these Terms, nonpayment, legal or security risk, or discontinuation of the Services. Cancellation normally closes the account at the end of the current paid period; an unconverted trial closes when the trial expires. We will identify the closure date in our notice or confirmation.
After account closure, paid functionality ends, but you have 30 calendar days to export Your Content using the available export tools or by contacting support. If normal access must be restricted, we will provide a reasonable secure export method unless prohibited by law or necessary to avoid exposing another person's data.
Active-system deletion will be completed no later than 90 calendar days after account closure, subject to the limited retention exceptions in the Privacy Policy and DPA. The 90-day period includes the 30-day export window; it is not an additional 90 days.
14.Disclaimers
TO THE FULLEST EXTENT ALLOWED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND TNH DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TNH DOES NOT GUARANTEE BOOKINGS, REVENUE, SAVINGS, BUSINESS RESULTS, INSURANCE APPROVAL, OR PROCESSING APPROVAL.
These disclaimers do not override an express commitment in these Terms or the DPA or a right or obligation that applicable law does not permit us to exclude.
15.Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, TNH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES. TNH'S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TNH IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.
TNH is not responsible for a separately contracted insurance or processing provider's decisions or performance. Nothing in this section excludes liability that cannot lawfully be excluded or limits TNH's responsibility for its own conduct where such a limitation is prohibited by law. Mandatory statutory rights remain unaffected.
16.Indemnification
To the extent allowed by law, you agree to defend and indemnify TNH against third-party claims and reasonable resulting losses and costs, including attorneys' fees, arising from Your Content, your messages, your services to clients, or your violation of these Terms or the law. This obligation does not apply to the extent a claim results from TNH's own breach, negligence, or willful misconduct. TNH will give prompt notice, provide reasonable cooperation, and allow you to control the defense with suitable counsel. A settlement imposing an admission or nonmonetary obligation on TNH requires TNH's written consent, not to be unreasonably withheld.
17.Disputes and arbitration
Please read this section carefully. It affects your rights.
First email success@tnhsolutions.biz with the account details, a description of the dispute, and the requested resolution. We will try in good faith to resolve it within 30 days. This process does not prevent either party from preserving a claim before a deadline expires.
Unless you opt out as described below, disputes arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except where AAA or applicable law requires other rules, including applicable consumer rules. The Federal Arbitration Act governs this arbitration agreement. Fees and hearing arrangements will follow the applicable AAA rules and mandatory law. Information about AAA and its rules is available at adr.org.
Either party may bring a qualifying individual claim in small claims court. To the extent permitted by law, you and TNH waive a jury trial for claims subject to arbitration and agree not to bring those claims as a class or representative action. This section does not restrict reporting concerns to government agencies or seeking remedies that cannot lawfully be waived.
You may opt out of this entire arbitration section by emailing success@tnhsolutions.biz within 30 days of first accepting these Terms. Include your name, account email, business name, and a statement that you opt out of arbitration. Opting out does not affect access to the Services. If the class-action waiver is unenforceable for a particular claim or remedy, that claim or remedy will proceed in court rather than class arbitration, to the extent required by law.
18.Governing law
Arizona law governs these Terms without regard to conflict-of-law rules, except as stated for arbitration or where mandatory law requires otherwise. Matters not subject to arbitration will be heard in the state or federal courts in Maricopa County, Arizona, subject to the small claims exception and any nonwaivable venue rights.
19.Changes to these Terms
We may update these Terms. For material changes, we will notify you by email or in your dashboard at least 30 days before they take effect. Changes apply prospectively. Continuing to use the Services after the effective date indicates acceptance to the extent permitted by law; we will obtain additional consent where required. You may cancel before a change takes effect. A change will not retroactively alter an already pending dispute.
20.General
These Terms, the DPA, and any expressly incorporated order or service terms form the agreement for the Services. The Privacy Policy explains our information practices; SMS Terms govern TNH's messaging program. The DPA controls conflicts concerning Client Data. If a provision is unenforceable, the remainder continues to apply, subject to Section 17. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets, subject to applicable law and our privacy obligations. Provisions that by their nature should survive account closure do so.
